These terms govern the use of Focus Pack: the apps for iPhone, iPad, Mac and Apple Watch, the Linux command-line client, the optional sync service and this website, all provided by COFFEE BYTES, UNIPESSOAL LDA, Avenida Infante, No. 8, Edifício Executivo, 2. K, 9000-015 Funchal, Madeira, Portugal (“we”). By installing or using Focus Pack you agree to them. Our privacy policy explains how data is handled.
1. The service
Focus Pack is a focus timer with companions. It starts and ends focus sessions, can switch Do Not Disturb on and off through system features, records your sessions and statistics, and lets virtual companions grow with your focus history. The optional sync service continues a session across your devices and keeps the minimum data needed for that. Features may change over time; we will not remove the core timer or your access to your own data.
2. Your account and your data
Focus Pack needs no account. If you turn sync on, an anonymous account is created for your devices. You are responsible for the devices you pair and may remove any of them at any time in Settings → Sync. Your sessions, companions and achievements remain yours; we claim no rights to them.
3. Availability
We work to keep the sync service available but cannot promise uninterrupted operation. Maintenance, updates, failures of hosting or network providers and circumstances beyond our control may interrupt it. The timer, the companions and your local history keep working without the service.
4. Prices and purchases
Focus Pack is currently free, and the companions will never be locked behind a payment. If paid features are introduced, they will be sold through Apple’s App Store under Apple’s terms, which also govern billing, renewals, cancellations and refunds. Prices will be shown before any purchase.
5. Right of withdrawal
Consumers in the European Union have a 14-day right of withdrawal for distance contracts. For purchases made through the App Store, Apple handles withdrawals and refunds. For anything bought directly from us, write to contact@coffee-bytes.io within 14 days of the purchase; where you asked us to begin providing a service during that period, you pay for the part already provided.
6. Acceptable use
You agree not to:
- overload, probe or disrupt the sync service, or access it other than through Focus Pack and its documented clients;
- attempt to access accounts or data of others;
- remove copyright notices or redistribute the companion artwork, drawings or other material outside the app.
Open-source components bundled with Focus Pack remain under their own licences, which are listed in the app.
7. Intellectual property
Focus Pack, its name, the companion characters and artwork, texts and designs are protected by copyright and trademark law and belong to Coffee Bytes LDA or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use Focus Pack on devices you own or control, under Apple’s licence terms for apps obtained from the App Store.
8. Liability
We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. In all other cases our liability is limited to the damage that was foreseeable and typical when these terms were agreed, and we are not liable for indirect or consequential loss, including lost focus history where you turned off the backups the system offers. Mandatory consumer rights under the law of the country you live in remain unaffected. Focus Pack is not a medical or safety device; Do Not Disturb settings are applied by your operating system and may not silence every alert.
9. Termination
You may stop using Focus Pack at any time; deleting the app removes its local data, and removing your devices under Settings → Sync deletes your sync account. We may suspend or end access to the sync service with reasonable notice if these terms are violated, or if the service is discontinued, in which case we will give at least two months’ notice and the app will keep working with local data.
10. Changes to these terms
We may change these terms when the service changes or the law requires it. Material changes will be announced in the app at least two months before they take effect; if you do not agree, you may stop using the service before that date. Continued use after the date means you accept the new terms.
11. Governing law and disputes
Portuguese law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live also apply, and you may bring claims in the courts of that country. Consumers in Portugal may use the electronic complaints book at livroreclamacoes.pt and the consumer dispute resolution bodies listed at consumidor.gov.pt. Should a provision of these terms be invalid, the remaining provisions stay in force.
